Kansas Overtime Pay Law

In Kansas, work in excess of 46 hours in a week must be compensated at a rate not less than one and one-half times the regular rate of pay. Special rules apply to law enforcement personnel and fire fighters, security personnel, and emergency medical personnel. Exempt from the overtime law are: (1) employees exempt from minimum wage standards; (2) employees selling motor vehicles for a nonmanufacturing employer primarily engaged in selling vehicles to ultimate purchasers; and (3) prisoners.

I run a business where I work for multiple customers throughout the week. At the end of the week my men may have over 40 hours, who do I charge the overtime to? One answer I have heard since I run an excavation business is to charge a hourly rate for the equipment which includes the crew and anything over 8 hours daily charge overtime rate for the equipment. Example my hourly rate is $240/hour over 8 hours would be $290/hour. This would cover me at the end of the week for any overtime costs. Is this legitimate??
